Leonchuk Studio — Permanent Makeup & Tattoo Removal

 

1. SUBJECT OF THE AGREEMENT

This offer governs the terms and conditions of permanent makeup (PMU), tattoo removal, and related procedure services. The agreement comes into force upon signing the client card and procedure consent form. This offer is valid for clients from all countries worldwide.

 

2. CLIENT OBLIGATIONS

The client confirms that they:

 

have read the information card, questionnaire, and all studio documentation

have provided complete and accurate information about their health condition, medications taken, and past illnesses

have no contraindications to the procedure at the time of its performance

are not under the influence of alcohol or narcotic substances

have followed pre-procedure recommendations and commit to following post-procedure recommendations

 

 

3. LIMITATION OF LIABILITY FOR RESULTS

The Service Provider shall not be liable for:

 

any discrepancy between the expected and achieved result, provided the scope of the service was agreed upon before its performance

the durability and quality of the result, which depend on individual factors including skin type and condition, immune response, age, medications taken, adherence to post-procedure care, sun exposure, and exfoliating treatments

activation of the herpes virus (Herpes simplex) following the procedure

complications arising from the client's concealment of health information or failure to follow recommendations

results in the presence of contraindications that the client failed to disclose

 

Claims based solely on the client's subjective expectations beyond the scope of the agreed result will not be accepted.

 

4. USE OF PHOTO AND VIDEO MATERIALS

The client consents to:

 

photo and video recording before, during, and after the procedure

use of materials for professional purposes including service effectiveness evaluation, portfolio, marketing materials, and publications on social media and the website

publication without disclosure of personal data (name, contact details)

 

Consent is voluntary and may be withdrawn in writing prior to publication of the materials.

 

5. PERSONAL DATA PROCESSING

5.1 Data Administrator

The administrator of personal data is Leonchuk Studio. Contact: contact@leonchuk.studio

5.2 Purposes of Processing

Personal data is processed for the purposes of:

 

maintaining client documentation and procedure records

ensuring the safety and quality of services

fulfilling legal obligations

marketing communications (with separate consent)

communication regarding appointments, results, and post-procedure care

 

5.3 Scope of Data Processed

first and last name, date of birth, email address, phone number, health condition (to the extent necessary for safe procedure performance), photo and video materials.

5.4 Legal Basis

 

EU / GDPR (Europe): processing is carried out pursuant to Art. 6(1)(a)(b)(c) of Regulation 2016/679 (GDPR)

USA / CCPA (California): California residents have the right to access, delete their data, and opt out of its sale pursuant to the California Consumer Privacy Act

Other countries: processing is carried out in accordance with applicable local personal data protection legislation

 

5.5 Client Rights

Regardless of country of residence, the client has the right to:

 

access their personal data

correct or delete their data

restrict or object to processing

withdraw consent at any time without affecting the lawfulness of prior processing

lodge a complaint with the supervisory authority of their country

 

5.6 Data Storage and Transfer

Data is retained no longer than necessary for the stated purposes. Data is not transferred to third parties without the client's consent, except where required by law.

 

6. INFECTIOUS DISEASES

The client undertakes to notify the studio if an infectious disease (including COVID-19) is detected within 7 days of their visit. If symptoms of illness are present at the time of the procedure, the service will not be provided.

 

7. CONSENT TO ANESTHESIA

The client consents to the use of proposed anesthetics and acknowledges that all forms of anesthesia carry a risk of complications.

 

8. GOVERNING LAW AND DISPUTE RESOLUTION

This offer is governed by the laws of the country in which the Service Provider is registered. In the event of disputes, the parties shall seek resolution through pre-trial settlement. EU clients have the right to use the ODR platform: ec.europa.eu/consumers/odr

 

9. FINAL PROVISIONS

 

The client has had sufficient time to review the documents and make an informed decision

Signing the client card constitutes full acceptance of the terms of this offer

The Administrator reserves the right to amend this offer with prior notification to clients
